What is the earnest money requirement?

In India, the standard EMD typically ranges between 2% and 10% of the property’s sale price. However, this percentage can vary based on factors such as  

  • Market Conditions: In high-demand areas, sellers might request a higher EMD to ensure buyer commitment.​ 
  • Property Value: For higher-valued properties, the EMD amount might be adjusted accordingly.​
  • Negotiations: Buyers and sellers can agree upon a suitable EMD amount based on mutual understanding 

For instance, on a property valued at ₹50 lakhs, an EMD of ₹1 lakh (2%) to ₹5 lakhs (10%) might be expected.​

 2. Legal Framework and Refund Conditions

The EMD is typically held in an escrow account managed by a neutral third party, such as a real estate agency or legal representative. The terms governing the EMD, including conditions for refund or forfeiture, are outlined in the sale agreement. Key considerations include
